These Terms of Service (the “Terms” or the “Agreement”) form a legally binding agreement between you (the “User”, “you” or “your”) and Tether AI. Inc, a company registered in the United Kingdom (“Tether”, “we”, “our” or “us”). You acknowledge and agree that your use of the Tether platform (the “Platform”), accessible through the website https://therealtether.com (the “Site”) and through native messaging services (iMessage, SMS), is governed by this Agreement, by our Privacy Policy and by any related terms.

IMPORTANT LEGAL NOTICE. Please read all of the following provisions carefully. By accessing the Platform, ticking an acceptance box, or using our Services, you acknowledge (a) that you have read and understood these Terms, (b) that you are at least 18 years old (or the legal age of majority in your country of residence), (c) that you have the legal capacity to enter into a contract, and (d) that you agree to be bound by these Terms and by our Privacy Policy. If you do not accept these Terms, you must not use the Site or the Platform.

1. About the Platform

Tether is a conversational artificial intelligence platform that plugs into your native messaging app (iMessage, SMS) to offer a caring companion the User can talk to in order to turn difficult moments into sincere conversations (the “Services”).

2. Privacy Policy and GDPR

Our Privacy Policy describes how we process the personal data you provide to us. By using the Platform, you acknowledge that you have read this policy.

Under Regulation (EU) 2016/679 of April 27, 2016 (“GDPR”) and the UK Data Protection Act 2018, you have the following rights over your personal data:

  • right of access (art. 15 GDPR);
  • right to rectification (art. 16 GDPR);
  • right to erasure, the “right to be forgotten” (art. 17 GDPR);
  • right to restriction of processing (art. 18 GDPR);
  • right to data portability (art. 20 GDPR);
  • right to object, including to profiling (art. 21 GDPR);
  • right to withdraw your consent at any time, without affecting the lawfulness of prior processing;
  • right to set instructions regarding the fate of your data after your death;
  • right to lodge a complaint with your local data protection authority.

You may exercise these rights at any time by writing to contact@therealtether.com. We undertake to respond within one (1) month, which may be extended by two (2) further months where complexity or volume of requests so justify.

3. Eligibility

To use the Platform, you represent and warrant that you:

  • (a) are at least 18 years old;
  • (b) are not currently prohibited from accessing the Platform;
  • (c) are not a competitor of Tether, nor using the Platform for competitive purposes;
  • (d) maintain only one registered account at a time;
  • (e) have full legal capacity to enter into this Agreement;
  • (f) do not violate the rights of third parties, including intellectual property rights;
  • (g) bear all costs (equipment, internet connection, carrier fees) necessary to access the Platform.

4. Account creation

To access our Services, you must provide accurate, current and complete information (in particular phone number and, where applicable, first name). You will receive a message via iMessage or SMS containing a link or login code. You expressly consent to receive these messages for the purpose of creating and using your account.

You are solely responsible for keeping your credentials confidential and for any activity carried out from your account. You may not share your account or transfer access to a third party.

5. License to use

Subject to your compliance with these Terms, Tether grants you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license to access and use the Platform strictly for personal, non-commercial purposes.

You may not copy, adapt, modify, distribute, license, sell, transfer, publicly display, transmit or otherwise exploit the Platform, except as expressly authorized.

6. Intellectual property

The Platform, including the Site, the application, graphics, trademarks, logos and editorial content, contains material protected by intellectual property law (including copyright, trademark law and sui generis database rights) belonging to Tether or its licensors.

Any reproduction, representation, modification, publication, adaptation, in whole or in part, of the Platform, by any means whatsoever, is prohibited without Tether's prior written authorization and constitutes infringement punishable under applicable law.

7. Artificial intelligence and Content

(a) Your Content

When you use the Services, you may provide instructions, messages or other data (the “Inputs”) and receive AI-generated responses (the “Outputs”). Inputs and Outputs together form the “Content”. Subject to these Terms, you retain all rights to your Inputs to the extent permitted by applicable law. You acknowledge however that Tether may use the Content to provide, maintain and improve the Services, comply with the law and enforce these Terms.

(b) Model improvement — Objection

Unless you object, Tether may use the Content to develop or improve its Services and model performance. Tether applies a “privacy-first” approach: under no circumstances is confidential Content of one User shared with another User. You may object to this use at any time by writing to contact@therealtether.com.

(c) Accuracy of Outputs

Artificial intelligence is a fast-moving field. Due to the probabilistic nature of the models, Outputs may be inaccurate, incomplete or fail to reflect reality. Tether is not a medical, psychological, legal or financial service. If you are in distress or considering harming yourself, please contact your local emergency services or a suicide prevention hotline immediately (in the US: 988; in the UK: 116 123). You must assess the relevance of any Output before relying on it, in particular in sensitive or decision-making contexts.

8. Required and prohibited conduct

a. Required conduct

  • Comply with all applicable laws, including tax, data protection and export-control laws;
  • Provide Tether with accurate information and keep it up to date as needed;
  • Read and understand the Privacy Policy;
  • Respect any notice sent by Tether regarding the Platform.

b. Prohibited conduct

In particular, you may not:

  • duplicate, license, sublicense, publish, broadcast, transmit, distribute, sell, resell or commercially exploit the Platform;
  • reverse-engineer, decompile or disassemble the Platform;
  • use the Platform to provide a competing service;
  • claim, directly or indirectly, to be affiliated with Tether without written agreement;
  • use automated means (bots, scripts, scrapers) to interact with the Platform;
  • undermine the security or proper operation of the Platform (viruses, attacks, overload, bypassing protections);
  • use the Platform to harass, threaten, defame or harm anyone;
  • use the Platform for unlawful, fraudulent or misleading purposes;
  • submit any unlawful, hateful, discriminatory, violent, sexual content involving minors, or content promoting terrorism, self-harm, suicide or other dangerous acts;
  • exploit a vulnerability related to another person's age, disability or socio-economic situation;
  • submit personal data about third parties without their consent.

9. Communications

You acknowledge and accept that, as part of the Services, you will receive messages from Tether by email, push notification, SMS or iMessage. Your carrier may charge you fees, which remain your responsibility.

You may unsubscribe from promotional messages at any time via your device settings or by replying “STOP”. Messages that are strictly necessary for the operation of the Service cannot be disabled without deleting your account.

10. Pricing

The Platform is currently provided free of charge. Any future change will be communicated in accordance with Section 17 below. For any future paid Services, consumers will benefit from a fourteen (14) day right of withdrawal under applicable consumer protection laws, except where the service has been fully performed with your express prior consent and your express waiver of the right of withdrawal.

11. Warranty and liability

As a consumer, you benefit from the legal warranty of conformity and the warranty against hidden defects under applicable law.

The Platform is provided “as is” and “as available”. To the maximum extent permitted by applicable law, Tether shall not be held liable for any indirect, incidental, special or consequential damages arising out of the use or inability to use the Platform.

This clause does not apply where liability cannot be limited or excluded by law, in particular in cases of fraud, gross negligence, bodily injury or a mandatory legal warranty.

12. Indemnification

You agree to indemnify and hold harmless Tether, its officers, employees and agents, against any claim, loss, liability or expense (including reasonable attorneys' fees) arising out of (i) your breach of these Terms, (ii) your negligence, fraud or willful misconduct, (iii) inaccurate information provided by you, or (iv) your failure to comply with applicable laws.

13. Suspension and termination

You may terminate your account at any time by sending a request to contact@therealtether.com.

Tether reserves the right to suspend or terminate your account at any time, in particular in case of (i) breach of these Terms or the Privacy Policy, (ii) legal risk created by your use, or (iii) discontinuation of the Services. Tether will, where possible, inform you in advance.

14. Reporting unlawful content

Under Regulation (EU) 2022/2065 (“Digital Services Act”) and applicable national laws, any user may report manifestly unlawful content to contact@therealtether.com. The report must include: the date, your identity, the description and precise location of the content, the reasons why it is unlawful, and, where required, a copy of the correspondence sent to the author of the content.

15. Force majeure

Tether shall not be held liable for any failure to perform its obligations resulting from a case of force majeure as defined by applicable law and case law.

16. Assignment

This Agreement is entered into intuitu personae with you. You may not assign it or transfer its benefits without Tether's prior written consent. Tether may freely assign or transfer this Agreement in the context of a restructuring or business transfer.

17. Changes

Tether reserves the right to amend these Terms at any time. Material changes will be notified to you by email or through the Platform within a reasonable time before they take effect. Your continued use of the Platform after the changes take effect will constitute your acceptance of those changes.

18. Independence of the parties

The parties are independent contractors. Nothing in these Terms shall be construed as creating a partnership, joint venture, employer-employee or agency relationship.

19. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute relating to their formation, interpretation or performance shall fall within the exclusive jurisdiction of the English courts, without prejudice to any mandatory consumer protection rules in your country of residence.

EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

20. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
